Terms of Use

These Terms of Use (“Terms”) govern your use of MatterTracker (“the App”, “the Service”, “we”, “us”), a case-tracking tool for advocates and litigants operated by Himanshu. By creating an account or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. What the App does

MatterTracker helps you follow your matters before the courts and tribunals it supports. It retrieves publicly available court information — cause lists, live display boards, case records and orders — matches it against the matters you choose to track, estimates how many matters away your case is, and sends you alerts you have configured. Where available, it may also show photographs of unofficial cause lists displayed outside individual courtrooms and use them to estimate the order in which matters may be taken up.

2. The App is an assistance tool only

MatterTracker is an assistance and convenience tool. It does not replace your own diligence, your clerk, or your duty to attend court. All listings, sequences, item numbers, display-board positions, estimates of how many matters away your case is, and notifications are provided on a best-effort, informational basis only. You are solely responsible for independently verifying every listing and the status of your matters against the official records of the court, and for appearing when your matter is called.

Nothing in the App is legal advice, and the App does not create any advocate-client relationship. Court records shown in the App are reproduced from public sources for convenience; the official record of the court always prevails.

You agree not to misuse the Service — including by attempting to access other users’ data, scraping or bulk-extracting data from the Service, interfering with its operation, reverse engineering it, using it for any unlawful purpose, or reselling it without our written consent.

7. Availability and changes

The App is currently provided free of charge. We may modify, suspend or discontinue the Service or any feature at any time, with or without notice, including where our data sources change or become unavailable. We may introduce paid features in the future; we will inform you before anything you use becomes paid.

8. Intellectual property

The App, its name, logo, design and software are our property or that of our licensors. Court records and cause-list information remain public information of the respective courts. These Terms do not grant you any rights in the App other than the personal, non-transferable right to use it in accordance with these Terms.

9. Limitation of liability

To the maximum extent permitted by applicable law: (a) the Service is provided “as is” and “as available”, without warranties of any kind, express or implied; (b) we shall not be liable for any indirect, incidental, special, consequential or exemplary damages, or for any loss of profits, business, reputation or opportunity, arising out of or in connection with the Service; and (c) our total aggregate liability for all claims arising out of or relating to the Service shall not exceed the amount you paid us for the Service in the twelve months preceding the claim (which, for a free service, is zero) or ₹1,000, whichever is higher. Nothing in these Terms excludes liability that cannot be excluded under applicable law.

You agree to indemnify and hold us harmless from any claim, demand or damage arising out of your misuse of the Service or your breach of these Terms.

11. Privacy

Our Privacy Policy explains what information we collect and how we use it. It forms part of these Terms.

12. Governing law and jurisdiction

These Terms are governed by the laws of India. Subject to any mandatory law to the contrary, the courts at Delhi shall have exclusive jurisdiction over any dispute arising out of or in connection with the Service or these Terms.

13. Changes to these Terms

We may update these Terms from time to time. The current version will always be available at this page, with its effective date shown above. Your continued use of the App after an update constitutes acceptance of the updated Terms.
